I think a rule prohibiting movable surfaces, such as the Toyota flex wing is as black and white as you can get. I don't see the loophole in the rules that allowed it. You can't design and build such a device by accident. There is clearly intent in this.
Excessive wear on the skid plank is more questionable, because there could be many different reasons for it. But in the end, rules are rules.
